Pozdrav,

da li se ima smisla žaliti na parking kaznu(došla mi je doma) za parkiranje na "žutom" parkingu kod Klaićeve bolnice kada smo malog vodili u 23h na hitnu? Portir je naveo da se slobodno možemo parkati ali očito je vozilo holdinga snimilo.
što mislite? postoji li šansa da oproste?

Sjećam se da kod portira pišu neke upute kako ostvariti pravo parkiranja tamo. I ja sam ga jednu večer/noć kad sam bio s klincem pitao za to pa mi je odgovorio nešto u stilu "ma samo parkiraj, šta se brineš". Nije mi bilo zgodno s bolesnim djeteom u rukama tada to istraživati, ali sad vidim da sam dobro prošao.

poslao sam i otpusno.
javim kako je prošlo.

Znali su i dizat aute na tom potezu ljudima tak da ništa čudno da su odbili. Tužno da takva ustanova nema adekvatan parking ali nažalost takva je situacijama u skoro svim zagrebačkim bolnicama.

Plati i šuti. Isto sam prošle godine platio u Puli jer sam se parkirao uz zid na hitnom prijemu jer sam dovukao mamu koja je pala u nesvijest i ozlijedila se. Auto pored mog nije imao kazne, pitao dežurnog zašto nije dobio kaznu, samo je zašutio.

Nije to nikakav apsurd nego standardna praksa u puno zemalja sto i treba biti. Usporedi samo kako vozacki ispit izgleda u Njemackoj i recimo u NJ. USA? Nepotrebno dalje komentirati.

Sto se tice A kategorije i propisa, to se da prepisati i *mozda* ti priznaju propise ali ne gine ti 2k+ € za B kat.

Zahtijevati vještačenje iako ga sud neće tražiti i to je to.

Dobiti kaznu za auto i regu koju nikad nisi imao, predobro

Ni ne trebaš podnosit žalbu, nego lijepo kod odvjetnika pa tužba svima redom u lancu.
Uopće se ne bi puno nervirao.

Deamon, pogledaj video pa ti bude jasnije. Lik je povukao neke možda naivne poteze, misleći da sudski sustav ima neku drugu funkciju.

nepalac jeste, tužba zbog grube povrede materijalnog prava i nanesene štete. Ako imaš djecu, objasni im što i kako jer dok to dođe na red trenutna generacija bude mahom pokojna. A advokata bude trebalo financirati.

To je sve skupa kafkijanski proces u kojem je sam proces kazna.

Ovo gore je, s punim poštovanjem, nebitno i netočno.
Za slanje žalbe na Visoki prekršajni sud (preko Prekršajnog suda) nije potreban advokat.
Rok je 8 dana mislim.

Što je nebitno i netočno?

Dakle, lik je dobio prekršajni nalog. Na njega je uložio žalbu preko odvjetnice i završio na sudu (3 godine kasnije). Sam nije bio prisutan na tom ročištu, iako ne znam koliko je to uopće relevantno.

Sutkinja je prema članku 244, stavak 1 prekršajnog zakona (koji je baš kriminalno pisan po mom sudu) donijela presudu po žurnom postupku prema članku 221

(ja pretpostavljam prema stavku 6 "po prigovoru protiv obaveznog prekršajnog naloga, zbog poricanja prekršaja" a mogla je po stavku 1 "za prekršaje za koje je je kao jedina kazna propisana novčana kazna do 1327,23€")

a iz 244 proizlazi da na takve presude nije dopuštena žalba.

Lik je imao pravo na žalbu prema visokom sudu u roku osam dana, ali je to propustio iz nenavedenih razloga.

Tako da taj "nema pravo žalbe" je više napisano da iritira čitatelja i da potakne klikanje. Reklo bi se da lik i odvjetnica nisu baš dobro odradili, koliko god cijeli proces bio katastrofalan. Iako nije na njemu da zna detalje, odvjetnica je trebala to bolje odraditi, vjerojatno.

Mislim da isto ovi krivo kazali, prekršajni nalog se napada prigovorom, ne žalbom. A spominje se i neki mail Ako je na mail policiji išta slao, to je moguće peak stupid.

Postoji i pravo za podnošenje molbe za povratak u prethodno stanje u roku od mjesec dana a nakon isteka roka od 8 dana za podnošenje žalbe.

Sve u svemu, užas svih užasa.

Lik je imao pravo na žalbu prema visokom sudu u roku osam dana, ali je to propustio iz nenavedenih razloga.
Da skratimo onda, čovjek se nije žalio, a mogao je. Na neki način si je sam kriv.

Što je nebitno i netočno?
Dakle nebitni su svi detalji, a netočna je tvrdnja da se nije mogao žaliti.

A što ćemo, i suci griješe, pogotovo ovi na prekršajnim sudovima, to je talog pravne struke i tamo završavaju najnesposobniji općenito. Primarna uloga im je po zakonima "if/then" sa "+/-olakotna/otegotna" = iznos kazne. Običan AI bi bolje radio taj posao, a bome neki koncentriraniji građanin koji ima ispred sebe običan zakon i samo izdiktira zapisničarki ono što već piše u zakonu, te isprinta.

Iz mog osobnog iskustva gdje sam plaćao 0-100% iznosa kazni, najbolje je u startu priznati i moliti za što manju kaznu. Manje njima za*ebancije, a to cijene. Kad vide da se netko pravi pametan tu po*izde. Isto vrijedi i za policiju

Krivo si shvatio.

Tražili su od njega da dadne vjerodostojan podatak o tome tko je vozio vozilo na fotografiji, a kojeg nije vlasnik. On ima auto bijele boje koji nije bijeli auto s fotografije (vozilo sa 5 vrata vs teretno vozilo kao caddy), vozač na fotografiji je netko drugi, dok se na fotografiji ne vidi registracija. Pogađali su registraciju, došli do njega nasumično, s njime i njegovima prekršaj skupa nikakve veze nema.

Tako da se ne bih složio da u ovom slučaju treba priznavati bilo kakvu krivicu. Koga je trebao imenovati kao vozača?

Na kraju su stavili da su ovi iz MUPa priznali grešku, pa bude to riješeno za 5-10 godina. Budu valjda toliko pametni da traže kamate na tu kaznu i sve troškove.

A da ima nesposobnih odvjetnika i sudaca, to sigurno ima. Jedino što je ovo, ako je vjerovati tome što lik govori, ekstreman primjer.

Sve u svemu, ovaj sistem s "žalba nije dopuštena" samo služi tome da sjebe ljude. Treba ići čitati prekršajni zakon, ili naći odvjetnika koji nije nesposoban, a isti je katastrofalno napisan.

Pa možeš ići do Suda za ljudska prava u Strassbour, kad iscrpiš sva pravna sredstva kod nas.
Znam za čovjeka koji je to napravio za 6kn oko kojih se sporio godinama, sam naravno, bez odvjetnika, i dobio na kraju

čisto ako netko zna ili je dobio kaznu - koji državni organ šalje kaznu za nepravovremeno produljenje prometne dozvole? odnosim se na onih 15 dana koliko je dozvoljeno zakasniti sa registracijom.

je li to lokalni MUP, neki glavni MUP, inspektorat, sud...?
