The background to the current development is the takeover of Nuvia by Qualcomm and the further development of the Phoenix CPU core, which was developed on the basis of an architecture license acquired from Nuvia and was originally intended to be used in the server segment, but is used by Qualcomm in an adapted form for a notebook design becomes. Qualcomm believes that by acquiring Nuvia, it has also taken over the architectural license and has the right to adapt the design developed by Nuvia to its own requirements.

Arm, in turn, argues that Nuvia had an architectural license specifically for server designs and a transfer to Qualcomm should not have happened without Arm's prior approval. A new license agreement would probably have been linked to this, as Qualcomm is currently using the further developed Phoenix design in the mass market for notebooks instead of servers and has recently completed and announced the second Oryon generation for a smartphone chip based on the architecture license. Nuvia's former architectural licenses were terminated back in February 2023 after Arm and Qualcomm were unable to reach an agreement.
